Data Sovereignty Policy

1.1 Data Controller

1.3 Legal Basis for Processing

1.4 Purpose of Processing

Personal data is processed exclusively for the following purposes: (a) responding to inquiries and establishing business communications; (b) executing requested services and maintaining project records; (c) ensuring website functionality and security; (d) complying with legal obligations; (e) improving user experience through anonymized analytics. We do not sell, rent, or share personal data with third parties for direct marketing purposes.

1.5 Data Retention

Personal data is retained only for the period necessary to fulfill the purpose for which it was collected, or as required by applicable law. Contact form submissions are retained for a maximum of 24 months from the date of last communication. Technical logs are automatically purged after 90 days. Anonymized analytics data may be retained indefinitely as it no longer constitutes personal data.

1.6 Data Subject Rights

1.7 International Data Transfers

Data collected through this website is processed within the European Economic Area (EEA). Where data transfers outside the EEA are necessary for service provision, we ensure appropriate safeguards are in place in accordance with Chapter V of the GDPR, including Standard Contractual Clauses approved by the European Commission.

1.8 Data Security

RidgeFoundryLabs implements appropriate technical and organizational measures to ensure a level of security appropriate to the risk, including encryption in transit (TLS 1.3), access controls, regular security assessments, and employee training on data protection practices. In the event of a personal data breach that is likely to result in a risk to your rights and freedoms, we will notify the competent supervisory authority within 72 hours as required by Article 33 of the GDPR.

1.9 Supervisory Authority

You have the right to lodge a complaint with the competent supervisory authority if you believe that the processing of your personal data infringes the GDPR. The relevant authority for RidgeFoundryLabs is the Agencia Espa\u00f1ola de Protecci\u00f3n de Datos (AEPD), located at C/ Jorge Juan, 6, 28001 Madrid, Spain.

2.1 What Are Cookies

Cookies are small text files placed on your device when you visit a website. They serve to recognize your device, remember your preferences, and improve your browsing experience. Cookies do not contain executable code and cannot access data stored on your device outside the browser context.

2.2 Categories of Cookies Deployed

Strictly Necessary Cookies: These cookies are essential for the website to function and cannot be disabled. They are set in response to actions you take, such as setting your privacy preferences, filling in forms, or navigating between pages. Without these cookies, services you have requested cannot be provided.

Analytics Cookies (if enabled): These cookies allow us to count visits and traffic sources so we can measure and improve site performance. They help us understand which pages are most and least popular and how visitors move through the site. All information collected is aggregated and anonymous.

2.3 Specific Cookies in Use

rf_cookie_consent \u2013 Stores your cookie preference (accepted/declined). Type: Strictly Necessary. Duration: Persistent (12 months). Purpose: Records your consent choice to prevent the banner from reappearing.

2.4 Managing Cookies

You may manage cookie preferences at any time through your browser settings. Most browsers allow you to block or delete cookies. Please note that disabling strictly necessary cookies may impair website functionality. You can also change your consent at any time by clearing the rf_cookie_consent entry from your browser's localStorage.

2.5 Third-Party Cookies

RidgeFoundryLabs does not deploy third-party tracking cookies. The Google Maps embed on our contact page may set cookies governed by Google's own privacy policy. We have configured the embed to use the loading="lazy" attribute and do not enable Google Analytics tracking through this embed.

Refund Terms

3.1 General Refund Policy

RidgeFoundryLabs provides digital services and custom-engineered solutions. Due to the bespoke nature of our work, refunds are evaluated on a case-by-case basis according to project milestones, work completed, and contractual agreements in place at the time of the request.

3.2 Pre-Project Cancellation

If a project is cancelled before any work has commenced, a full refund of any advance payments will be issued within 14 business days, less any non-recoverable third-party costs already incurred (such as domain registrations, software licenses, or infrastructure provisioning).

3.3 Mid-Project Cancellation

If a project is cancelled after work has commenced, compensation will be calculated proportionally based on the percentage of the project scope completed and approved at the time of cancellation. Milestone-based billing ensures that payments already received for completed and approved milestones are non-refundable. Any work in progress that has not yet been approved will be assessed and compensated proportionally.

3.4 Post-Delivery Refund Window

Following final delivery, a 14-day review period is provided during which the client may request corrections for deliverables that materially deviate from the approved project specification. Requests for corrections must be submitted in writing with specific references to the agreed specification. Full refund requests during this period will be evaluated based on the severity of deviation from the agreed scope.

3.5 Non-Refundable Items

The following are non-refundable: (a) third-party licensing fees and subscriptions procured on behalf of the client; (b) domain registration and hosting fees already incurred; (c) consulting hours delivered and documented; (d) work approved through the client's formal sign-off process.

3.6 Refund Request Procedure

All refund requests must be submitted in writing to [email protected] with the subject line "Refund Request \u2013 [Project Name]". Requests will be reviewed within 5 business days, and a determination will be communicated in writing. Approved refunds will be processed within 14 business days using the original payment method.

Service Agreement

4.1 Acceptance of Terms

By accessing this website, submitting an inquiry, or engaging the services of RidgeFoundryLabs, you agree to be bound by these Terms of Service. These terms constitute the entire agreement between you and RidgeFoundryLabs regarding the use of our website and services. If you do not agree with any provision of these terms, you must discontinue use of our website and services immediately.

4.2 Scope of Services

RidgeFoundryLabs provides digital engineering, web development, and strategic consulting services as described on this website and as further specified in individual project proposals and statements of work. The specific scope, deliverables, timeline, and pricing for each engagement are defined in the respective project agreement signed by both parties. These general terms supplement, but do not replace, project-specific agreements.

4.3 Payment Terms

Unless otherwise specified in the project agreement: (a) invoices are due within 14 days of the invoice date; (b) milestone-based billing follows the schedule defined in the project agreement; (c) late payments incur a statutory interest rate of 8 percentage points above the ECB base rate in accordance with Directive 2011/7/EU; (d) work may be suspended if payment is more than 14 days overdue.

4.4 Intellectual Property

Upon full payment of all applicable fees, the client receives a perpetual, non-exclusive license to use all custom deliverables produced under the project agreement for their intended business purpose. RidgeFoundryLabs retains the right to use generalized methodologies, frameworks, and know-how developed during the engagement. Pre-existing intellectual property remains with its original owner. Third-party components are subject to their respective license terms.

4.5 Confidentiality

Both parties agree to maintain the confidentiality of all proprietary information shared during the course of the engagement. This obligation survives the termination of the agreement for a period of 24 months. Confidential information shall not be disclosed to third parties without prior written consent, except as required by law.

4.6 Limitation of Liability

RidgeFoundryLabs shall not be liable for indirect, incidental, special, or consequential damages arising from the use of our services or website. Our total liability for any claim arising from or related to a project engagement shall not exceed the total fees paid by the client under the applicable project agreement. We are not liable for delays or failures in performance resulting from causes beyond our reasonable control.

4.7 Termination

Either party may terminate a project agreement with 14 days written notice. Upon termination, the client shall pay for all work completed and approved up to the date of termination. RidgeFoundryLabs shall deliver all completed work product within 10 business days of receiving final payment. Provisions regarding confidentiality, intellectual property, and limitation of liability survive termination.

4.8 Governing Law and Dispute Resolution

These Terms of Service are governed by the laws of Spain. Any disputes arising from or related to these terms or the services provided by RidgeFoundryLabs shall first be attempted to be resolved through good-faith negotiation. If negotiation fails within 30 days, disputes shall be submitted to the competent courts of Zaragoza, Spain. In accordance with EU Regulation 524/2013, you may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

4.9 Amendments

RidgeFoundryLabs reserves the right to modify these Terms of Service at any time. Changes take effect upon publication on this website. Continued use of the website or services after publication constitutes acceptance of the amended terms. Material changes to existing project agreements require written consent from both parties.
